TRIAL
DIVISION
The
jurisdiction of Supreme Court of Newfoundland (Trial Division) includes:
Criminal:
unlimited jurisdiction in all criminal matters bestowed upon it by the
Criminal Code and relevant statutes;
Family:
 jurisdiction over nullity, judicial separation, corollary relief,
divorce, matrimonial property, custody, access, guardianship and interspousal Criminal Code offences, except in St. John's and parts of
the Avalon and Bonavista Peninsulas where these matters fall under the
jurisdiction of the Unified Family Court;
Civil:
jurisdiction over all civil actions. However, cases involving financial
disputes are generally above the small claims limit of $5000; and
Estates Division:
The Registrar, in his own right, and through
his staff in the Estates Division of the Supreme Court, acts as
and carrys out public guardian, guardian ad litem and public
trustree functions for minors, mentally disabled and other
persons pursuant to court appointments and a variety of
statutes.
Appeals:
the Court hears criminal appeals from summary convictions in Provincial
Court and civil appeals from Provincial Court (Family Division) and
(Small Claims Division). |
